OK - moving forward.  For the "next law of gold," Clayton Johnson advises us to "invest in future income."

  In the 21st century, this simply means preparing for your retirement.

    It is pretty much a given as I write this that the idea of retiring at 65 (for most people) in America is a pipe dream.  First, the idea of retiring at 65 was more or less an arbitrary number decided by Otto von Bismark, the German chancellor who developed the modern German state in the late 19th/early 20th century.  The "65" number was accurate at the time it was made since the average lifespan of a person during that time period was about 60, so a person who lived to 65 and beyond was already ahead of the game.  Now, of course, the average lifespan for an American is about 80, which means that any retirement savings must last at least 15 years past the retirement age of a worker.

     Retirement schemes are, of course, a major opportunity for fraudsters.

OK - we discussed how owning a home was important in the long-term financial scheme of things.  Most financial planners will state this.  However, just because it is a good financial option does not mean that it is the only financial option for everyone.

     In terms of fraud, owning a home and the desire to own a home presents a gold mine of opportunities for fraudsters trying to exploit this desire.  It is beyond the scope of this post (or books for that matter).  The desire for "everyone" to own a home has led to financial disaster, the most recent one being the near-depression crash of 2008. 

    So, although the financial advice is, more or less, sound about owning a house, there are some important considerations to review before making such a purchase.  Perhaps the biggest question is - are you in a financial position to own a house?

   We will look at this later.

So, in the last installment, the author advises us to "make thy home a profitable investment."  Why is this a good idea?

     It should be obvious that when a person owns a home, he is not paying money for rent which is, in a sense, money wasted.  All money which is paid in rent goes to a third party and the tenant is not getting anything in return for the rent (aside from the obvious, of course, that the tenant gets a roof over his head).  However, when a person owns his own home, the money is set aside for investment and the purchaser gets the benefit of an investment along with that of a roof.  Most people in America cannot afford to purchase a house outright, but even so, the money paid towards the mortgage is money which is paid towards the future acquisition of the house so, in the end, there is a direct benefit.

OK - the next rule that the author tells us is to "make thy home a profitable investment."  In other words, it is better to own a house (for most Americans, this means to have a mortgage which eventually will mean the house will be paid off and then the person will outright own his house.

Better than renting, right?

At the last post, we asked a good question:

"However, as we discussed on this thread before, a common thread among experienced fraudsters is to get a person "hooked" by making certain that small investors will get good returns so as to entice these small investors to invest more.  This is an old trick.  The real question, therefore, is how to avoid this kind of scam?"

    One way to avoid this kind of scam is to be on the alert when a person who recommended the investment says something to the effect, "OK, I have proven myself to you with this small investment, now I have a REAL one for you!"  This kind of sudden notice that you can now earn a great deal of money despite the first investment making moderate returns should be a warning sign that something is amiss.

To my readers - I am sorry for the delay in posting.  Things have been very busy and sometimes this blog gets overlooked.  I enjoy writing for the blog and I don't like to miss posts.

     At the last post, we discussed the very positive benefits of small investments at first.  This is a good philosophy for several reasons, but one of the best reasons is that: (1) it helps to invest slowly to check out an investment at first and (2) if an investment goes south, then all of your savings will not be lost.

OK - getting back to Johnson's admonition to "guard thy treasure against loss."  Johnson's advice is on investing and, as discussed previously, Johnson advises to invest money in small sums at first before risking larger investments.

     As an attorney who investigates and defends people from fraud, I can only state that this is the most sound advice in investing I have ever heard.  Victims of fraud generally invest most if not all of their money into an investment scheme.  This is the greatest problem with fraud victims - they tend to lose everything (or most of it) in these schemes.  The loss of any monies is problematic but when an entire life's savings is gone, the tragedy is even deeper. 

      Investing in a small way at first is not a complete guarantee that a fraud will not happen, but it is a good start.  Of course, there is always the old story that a fraudster will entice a small investment at first and then work into a larger one, which is often the case.

     But, this is a story for the next post.

OK - let's move onto the next chapter in George Clayton Johnson's classic.  His advice for wealth building, after "starting they purse to fattening" (i.e. investing money) is: "Guard thy Treasure from Loss."

     If you remember in our last post, we discussed how the investment part of Johnson's instructions is the part where fraudsters can get the best of you.  After all, fraudsters and white collar criminals are always offering "investment schemes" to individuals.  It is in the next chapter, however, where Johnson tells us how to avoid such scams.  His advice begins with the first sentence of this chapter:

"Misfortune loves a shining mark. Gold in a man's purse must be guarded with firmness, else it

be lost. Thus it is wise that we must first secure small amounts and learn to protect them before the

Gods entrust us with larger."
 
     Clayton advises us to learn how to invest small amounts first before risking large investments.

So - we are advised to make our gold multiply - in other words, to invest our monies, not just to let the monies sit around and do nothing.  As we stated earlier, this is a double-edged sword.  Yes, we want to invest our savings into some sort of profitable enterprise or something that will  make our money work for us.  If we don't, then our savings will get eaten up by inflation or, at the very least, will stagnate in value.

      But, the double-edged sword is that it is through investments that the con artists and fraudsters come calling.  We want to invest our money but we don't want to be a victim of fraud.

     In this chapter on investments, George Clayton, the author of "The Richest Man in Babylon" tells us to invest so the earnings are reasonable.  He is not telling us to invest in some scheme that promises a big payoff or a huge rate of return.  It is only through reasonable investments that work in the long term that real money is made.

     Just by following this advice alone, most pitches of con artists would reach deaf ears.

OK - so moving on to the next "remedy" for being poor.  The third hint to keep acquiring wealth is to "make your gold multiply."  In other words, invest your money (or more specifically, your savings).  Don't spend your savings and don't leave it around not doing anything (a/k/a leaving it in your mattress).  If you money "works" for you, then you eventually can retire.

     This is the real sticking point when it comes to fraud.  Any decent financial advisor will, of course, advise you to invest your money.  That is the entire point of earning money in the first place - to put it to good use so eventually you can work less (or retire completely).  Unfortunately, it is the desire to invest money that attracts con artists.

OK - returning to the theme of the previous post, namely - control expenditures. 

     Keep track of what you spend.  Keep a record of what you spend.  What expenditures are necessary, what expenditures are frivolous?  If you can track what you spend, then you will begin to note what is important and what is a waste of money.

      This is important in terms of fraud for a variety of reasons.  First, keep in mind, as we have discussed numerous times on this blog, fraudsters generally want their targets ignorant.  They  certainly do not want their targets to investigate into what their money is asked to be invested.  If a target has a track history of keeping track of spending, then it is only a short jump for a person to want to know the investment "scheme" of a fraudster.

     Second, once again as discussed, many fraudsters attempt to "fast talk" their targets into accepting the sales pitch.  If a person has a track history of keeping track of spending, then a "fast talk" would certainly be of less impression on the target.

OK - reviewing the parable from yesterday - a portion of what a person earns is his to keep.  In other words, pay yourself first.  Pay at least 10% of your earnings to yourself.  More if you can, but no less than 10%.  If you earn $1000, put away $100. 

      This is solid financial advice as any decent financial advisor would state.

      What is important about this for fraud control is that it is solid financial advice.  Most fraud schemes attempt to give you a short term fix - invest in this incredible opportunity NOW and you can earn 20% interest per year.  In other words, a get-rich-quick scheme which does not exist.  Putting your money aside, especially a modest amount, and letting it grow over a long period of time is solid financial advice.  Telling you that you can get quick in a few months (or even years) is usually a direction for disaster.

     So, George Clayson, the author of "The Richest Man in Babylon" was only reiterating sound financial advice when he advised his readers to pay themselves first.

Well - once again I have to apologize for the delay in posts.  The last few days have been insane with work to the point where I have had barely a chance to sleep.  But, fortunately, some free time has finally been unearthed and I have some time to get back to this.

     OK - The Richest Man in Babylon - parables for getting wealthy.  The book was written in 1926 and as I said before the writing style is simplistic and can be really annoying at times.  But the principles the book espouses are about as foolproof as you can get for acquiring wealth and, further, if a person follows this advice, the chances of him becoming a victim of fraud is greatly reduced.

     So - onto principal number 1 - "A portion of all you earn is yours to keep."

     Clayton advises that a person put aside at least 10% of his income.  In other words - pay yourself first.  If you earn $1000 per month, then take $100 and put it aside for long-term investment.  This "10%" rule, or more precisely, the "pay yourself first" rule, is the key for wealth acquisition.  The very first thing you should do upon getting paid or receiving any kind of monies is to put 10% aside and pay yourself.

Been a while since my last post - busy, busy, busy.

     One of the main points of this blog is to warn people of financial scams and also how to think critically when it comes to financial planning.  Along the lines of thinking critically, we will be spending the next series of posts analyzing a book written in the early part of the 20th century - "the Richest Man in Babylon by George Clason.

      The book is written in simplistic (and sometimes obnoxious) parables.  However, if you ignore the writing style, the book offers, IMHO, some of the best investment advice and advice on how to handle money ever written. 

     We will be analyzing the principles of this book (as I said, they are not hard to follow) and apply them in terms of fighting fraud.

Secrets of Con Artists 9

OK - wrap up this thread.

     What I have been trying to establish with this thread is that con artists have access to information about you and, in the 21st century, it does not take a whole lot of effort to get this information.  Remember that one of the most important, if not THE most important thing a con artist needs to do is to gain a person's CONFIDENCE (hence, of course, the name "con" artist).  There is no better way to gain such confidence then by seeming to know details about a person (or target) even before the target meets the con artist.

      I guess, in the end, this is just another example of the old Latin phrase: "caveat emptor" - buyer beware.  If someone is attempting to sell you something and knows details about your life that seem to make the two of you "click," then perhaps it is time to take a step back.  It is always commensense advice in this day and age to shred your credit card (and other billing information) and always be careful of what is thrown in the trash.  However, thanks to the internet, other personal information is sometimes available online.

      Another adage to always be careful.

Interludes - The Turing Test

We need to take a break for a minute to discuss the Turing Test.  This was a test developed by computer pioneer Alan Turing.  Turing stated that if computer artificial intelligence developed to the point where a person on the other end  of a conversation with a computer could not tell if he was speaking with a computer or with a person, then this was a case of true artificial intelligence.

    The Turing test passed today.

Secrets of Con Artists 8

OK - let's wrap up this thread.

     Con artists can collect information on a target very easily.  They can also get enough information to "read" a target, once again very easily.  This should be obvious after reviewing the past posts. 

      Con artists, like any other profession, require the that the artist do the research.  This is the ultimate "secret" of con artists (although it is not much of a secret) - they do their research when they are trying to hit big targets (or even small multiple targets).  The information they need is not very hard to obtain, especially in the 21st century. 

     Con artists do their research and they know how to evaluate their targets.  They know that the best way to ingratiate themselves to their targets is to have information before hand that will help them ingratiate themselves.

Secrets of Con Artists 7

Continuing with the same thread:

     One of the most important (in my opinion) "secrets" of con artists is that they have not changed in the thousands of years that confidence games have been around.  The only real difference is that today, with modern technology, a con artist has a vast amount of information available to him.  This observation, however, can be made about everyone. 

       Take a person like Bernie Madoff or Jeffrey Skilling back two thousand years ago to the time of the Roman Empire and they will still be able to operate the same kind of scams that they did in the 21st century.  The only difference is that they will be using papyrus and working with slaves. 

      We like to think that con games are a modern phenomenon, but as we have discussed many times in previous posts, they are nothing new.  A con artist will have you believe, however, that the investment scheme or investment idea is completely new - no one has ever thought of it before.

      Con men don't like to admit that they are strangely unoriginal.  In fact, many con artists will admit they recycle old ideas after hearing about them from other con artists or even from reading a history book.

Secrets of Con Artists 6

Sorry for the long delay, but as usual work has been very busy.

      We are back on track discussing some of the things that con artists do not like to have revealed.  We have already discussed how easy it is for con artists to get your personal information.  For these people, your personal information is a veritable gold mine.  This information can reveal not only what should be hidden information, such as your social security number or date of birth, but also information about your personal habits which can be used to enter into your life. 

      What is not so much known is that there is a veritable underground industry which buys and sells this information.  If you have ever seen the movie "Glengarry Glenn Ross," there is a scene where Alec Baldwin's character states that the owners of a company which sells real estate, "Mitch and Murray," purchased leads, i.e. phone numbers and addresses of people that filled out an information card so that a salesperson could follow up later.  The key is that the information, even if it was collected in a legal manner, can be used to ingratiate the salesperson with the prospective client. 

     It should not be surprising, therefore, to discover that information that has not been collected legally should also be up for sale.

Social media - everyone uses it (or seems like almost everyone).  Including me.  Facebook, Twitter, what have you.

     Social media is great but, like everything else, it has its dark side, other side of the coin, negative aspects, once again what have you. 

     In terms of what we are discussing, FB and other social media allows for the general public to find out information about yourself without much effort.  For example:

1.  Your birthday.  If you advertise your birthday, then of course it becomes available knowledge for anyone caring to look.  Don't forget, this can also include your year of birth.

2.  Your basic background information - where you graduated (and when) high school and college, the jobs you have had, how long you stayed at such jobs. 

3.  Your relationship history.

      It's easy to see just how this information can be used against you.  Remember to use your settings wisely and keep the information to those whom you want to have the information

Secrets of Con Artists 4

We were discussing the last post about the psychopathic/sociopathic tendencies of con artists.  Readers of this blog know that this is not the first time we discussed this.

     What makes it interesting, however, under the banner of "secrets of con artists" is that many psychiatrists and forensic analysts are just now beginning to understand just how psychopathic and sociopathic con artists can be.  It was never a big secret that fraudsters don't care about other people.  However, unlike burglars, robbers and other criminals who use force to get individuals (and corporations I suppose) to turn over money, fraudsters actually seem to enjoy the thrill of the con itself.  It is not so much the money or other financial incentives that attract fraudsters to this line of work (although, of course, it is a necessary element), but rather the creation of the plan and the thrill of getting the victim to believe in the fraudster.  It is just as critical for the fraudster to get some kind of psychological satisfaction or "high" if you will from the target.

     Think about this for a minute.  The average street mugger could care less what his victim thinks of him (and probably knows that his victim is scared of him because he has a gun or whatever).  A fraudster, however, gets just as much enjoyment out of the actual criminal act itself as getting the reward.

     This is what makes fraudsters unique in the criminal world.  It is not so much the reward, but how the reward is obtained.  This has been romanticized in movies like "The Sting" and other stories and I myself have confessed to being somewhat in amazement as to how fraudsters operate.  Most of us would like to have that kind of self-confidence that fraudsters emulate, almost unconsciously.  But the knowledge that a fraudster has this ability (or develops it) and uses it to screw people and gets a high from it really is what makes this type of criminal unique.

Secrets of Con Artists 3

We have discussed before on this blog the relationship between con artists and sociopaths/psychopaths.  To take advantage of someone, which is the heart and soul of a con operation, means that the person who is doing the con really does not care about the feelings of the target victim.  The entire point of a con operation is to gain the trust of that target and then exploit that trust for the immoral purposes of the con.

     It should not come as a surprise, therefore, that victims of fraud or con games were more than 50% likely to have recently experienced negative life events such as the death of a loved one, illness or a divorce.  Depression tends to run higher in the elderly and therefore it should also not be a surprise that the elderly are more likely to be the victim of fraud.

     Con artists may be sociopaths, but they are smart sociopaths.  They know which people to target.  It should not come as a surprise, therefore, that studies on fraudsters have demonstrated that they tend to look for (and often find) people that are going through a crisis point in their lives.  Such individuals often find that they are in need of a friend, and all too-often a con artist is willing to be that friend.

Interludes - Welcome Tunisian Readers

Like any mildly egotistical blogger, I always check the stats of people visiting my blog.  The stats also provide me information as to the people from different countries who are visiting.  To my great surprise and delight, I found that recently a number of bloggers from Tunisia have begun to tune in.

     First, - welcome!  I am always happy to welcome international visitors. 

     Second - a special welcome to those visitors from Tunisia.  Tunisia is an interesting country - a North African country which for years was under the control of a corrupt and autocratic government.  Tunisia was the country that started the "Arab Spring," when a vendor set himself on fire to protest policies.

     Tunisia represents an example of what corruption can do to a country. Organizations such as Transparency International fight against corruption and work tirelessly to expose it.  Corruption and crony capitalism can not only disrupt commerce, it can cause misery for millions of people in a country and, further, can literally retard a country's intellectual and economic growth.  It can prevent a country from reaching its potential and, even worse, can actually lower a country's GDP and force millions into poverty.
 
     The Tunisian revolution occurred, in part, because of the intense corruption in the country.  Here is to a better future.

Secrets of Con Artists 2

One of the biggest "secrets" of con artists that is actually one of the worst kept secrets in the world is that con artists have easy access to your information.  Very easy access.

     I'm not talking about items such as social security numbers or birthdays or addresses.  Yes, these can be found but you have to know where to look.  I'm talking about information such as your favorite food, where you work, your educational background, your likes and dislikes, information regarding your relatives, information regarding your pets.  Information that you think is private and is for you only.
 
      Con artists find this type of information to be a gold mine because it helps them build a personality matrix of you.  Remember - and we cannot say this enough - con games are confidence games.  The con man must have you develop confidence in him.  You must believe him otherwise there is no way the con man can ever get you to trust him. 

    Obviously the more a con man knows about you, the more he can get you to trust him.

We will spend the next few posts discussing some of the "secrets" of con artists.  By secrets, I do not mean some hidden knowledge known only to con artists (as we have seen several times over the course of many discussions, the only real "secret" to being a con artist is having a sociopathic personality and extreme self-confidence) but rather some aspects of being a con artist that are not well known.

     Con artists, as we have seen time and time again, play off the insecurities of their victims which is contrasted by the extreme self-confidence of the con artist.  Remember - the main element to every con artist is that they need to gain the confidence of their victim.  Confidence games.

Dangers of Being a Corporate Whistleblower 8

We have given an overview of what can befall a whistleblower.  You can file this under "life is not fair" (if you haven't figured that out already) but what is obvious is that doing the right thing does not always make a person a hero.  In fact, the consequences from being a whistleblower can not only be life-changing, they can be hazardous.

     The only advice I can give here is the obvious - get competent legal counsel before attempting to be a whistleblower.  A competent white collar criminal attorney can guide you through the process.

      Yeah, I suppose I am doing some in-house advertising with this post, but this is not done out of a way to get my name out there (OK, who am I kidding, of course it is), but because I have literally seen dozens of people attempt to do the right thing without counsel and find themselves in trouble up to their neck.  I cannot stress this enough - if you work for a corporation, and you are attempting to be a whistleblower against this corporation because you discovered fraud, in some way you probably helped the corporation commit the fraud in the first place, even unknowingly.  This means that you are part of a conspiracy.

      Blowing the whistle on corporate fraud is not the same thing as stopping a robbery in progress (and I don't advise doing THAT unless you have significant REAL martial arts experience and/or military or police experience and are armed yourself).  Corporate fraud does not take place in a vacuum - there are always a group of people involved, once again either intentionally or unintentionally.  Thinking you can be a hero and expose corporate fraud without consequences or repercussions is a one-way ticket to a disaster.

     I don't want to discourage anyone from doing the right thing.  But, I want potential whistleblowers to do the right thing in the right way.
